Mom of Dover-area man killed by officer files notice to sue

The mother of a Dover-area man fatally shot by Northern Regional Police late last year has filed notice of her intent to sue the police department in York County Common Pleas Court.

Called a "praecipe," the notice was filed Monday, March 19, in the York County Prothonotary's Office.

Isaiah Christian Green was fatally shot by a Northern York County Regional police officer on Dec. 28, 2017.

It lists Lana Green — mother of Isaiah Christian Green and administrator of his estate — as plaintiff and Northern York County Regional Police Department as the civil defendant.

Isaiah Green, 21, of the 3800 block of Kings Lane in Dover Township, was fatally shot at his home by a Northern Regional officer just before 2 a.m. Dec. 28, 2017, state police have said.

Unlike an actual lawsuit, a praecipe doesn't list details or allegations. It simply puts the defendant, the court and the public on notice that a civil lawsuit is expected to be filed.

Stephen Greecher, attorney for Lana Green, is out of town this week, according to his voicemail. He could not be reached for comment.

Philadelphia-area attorney Joseph Santarone Jr., who represents Northern Regional Police, said he can't yet comment because so far a lawsuit hasn't been filed.

He said he believes if a lawsuit is filed, it will be done in federal court.

The plaintiffs filed their intent to sue in York County Court so they have the ability to subpoena certain records in the case, according to Santarone.

The background: An officer was called to the Green home for an unknown problem, according to state police.

Once at the home, the officer was approached by Isaiah Green, who was in his garage with an AR-15 semi-automatic rifle, state police have said.

The officer then fatally shot Green, according to state police.

Green died of a gunshot wound to the torso and left shoulder, York County Coroner Pam Gay has said.

Troopers investigated after Northern Regional Police Chief Mark Bentzel requested that an outside agency conduct an independent investigation into the police-involved shooting, according to Bentzel.

It will be up to York County District Attorney Dave Sunday to determine whether the shooting was justified, according to DA's office spokesman Kyle King.

Dover Eagle: Green graduated from Dover Area High School in 2015.

While there, he was a running back and inside linebacker for the Eagles' football team. Green rushed 1,161 yards his junior year.

As a junior and a sophomore, he earned a first-team selection on the York-Adams Division II Coaches' All-Star Team. He rushed for 622 yards as a sophomore.

At the time of his death, Green was a recent graduate of Kentucky Welding Institute, according to school spokesman Adam Hinton.

"We had nothing but positive experiences in all dealings with Isaiah during his time at our school and while he was in our community," Hinton wrote to The York Dispatch. "He was a solid, respectful young man."
