Man accused of assaulting Penn Twp. cop

A man is accused of kicking a Penn Township Police officer over the weekend, according to officials.

Township police say Ernest Preston Smith IV, 41, injured an officer when he lunged and kicked at him.

Smith, of the 600 block of York Street, is charged with aggravated assault, aggravated harassment by prisoner, DUI, resisting arrest and disorderly conduct.

Alleged incident: According to police, Smith crossed into the oncoming lane on York Street in his Nissan Sentra around 2 a.m. Sunday, Sept. 30.

An officer spotted him and pulled the vehicle over in the 600 block of York Street, court documents state.

Smith, who appeared lethargic, exited his vehicle and stumbled, officials said.

The responding officer told him to return to his car, but Smith refused, according to police.

Smith walked away into the backyard of a home, and the responding officer continued giving him commands to stop, but he didn't, charging documents state.

Police said he had a strong odor of alcohol coming from him, his eyes were bloodshot, and his speech was slurred. 

"Smith refused to put his hands behind his back and began to forcefully resist arrest, pulling away from me attempting to enter the residence," Officer Bryan McCusker wrote in charging documents.

A Taser was used on him, and Smith was eventually handcuffed, officials said. While under arrest he threatened police and lunged at and attempted to kick one of the responding officers, court documents state.

He injured that officer's left knee and left pinky finger, police said.

Officers transported Smith to Hanover Hospital before taking him to the county's central booking unit. While en route, he continued to be belligerent and attempted to strike officers, court documents state. 

Police said he threatened officers and tried spitting on one of them, and he did not stop even after he was given numerous warnings.

Smith was arraigned on the charges Sept. 30 and remains free after posting $5,000 bail.

He does not have an attorney listed.
