Former South Western athletic director avoids criminal conviction
Criminal charges were dropped against South Western School District's former athletic director after he pleaded guilty to a summary offense.
Kurt D. Brenner, 31, of Quartz Ridge Drive in Jackson Township, appeared in York County Court on Tuesday, July 24, where he pleaded guilty to the summary offense of harassment. Summary offenses are akin in seriousness to traffic tickets.
In exchange for his plea, a felony charge of strangulation was dismissed, as was a second-degree misdemeanor of simple assault, according to court records.
Brenner was ordered to pay a $300 fine and court costs, according to the York County Clerk of Courts office.
Common Pleas Judge Gregory M. Snyder ordered the fine and costs be paid within 60 days, court records state.
Kyle King, spokesman for the York County District Attorney's Office, said Brenner's plea agreement required him to complete treatment.
"After consultation with the victim and law enforcement, the commonwealth felt this was an appropriate resolution," King said.
Brenner resigned from the school district in April, Superintendent Jay Burkhart has said.
The background: Northern York County Regional Police said Brenner assaulted his wife the night of March 16 after a social gathering at their home where alcohol was consumed.
Brenner shoved his wife's head between couch cushions, blocking her nose and mouth, according to charging documents.
Candise Brenner said she "saw stars" and had trouble breathing, documents state; at one point she yelled to her husband, "You're going to kill me."
Kurt Brenner feigned sleep after officers arrived and denied his wife's version of events, according to documents.
His eyes bloodshot and glassy, he told officers he was asleep the entire time, documents state.
Brenner was hired by the school board in October 2017 at an annual salary of $81,000, according to meeting minutes.
He led the athletics department at Hanover High School before his hiring at South Western.
