Man accused of sexually abusing children
A man accused of having sex with a 13-year-old is now accused of sexually abusing two young children about two years ago, according to charging documents filed Wednesday by state police.
Brandon Lee Smith, 25, of 226 Park Place, York City, is charged with two counts each of involuntary deviate sexual intercourse with a child, indecent assault, corruption of minors and terroristic threats, among other charges, according to charging documents. Charges filed by York City Police listed Smith's address as 1105 Eberts Lane, Springettsbury Township, and his current address is unclear.
The new charges stem from two juveniles telling police that Smith had abused them inside the detached garage of their York City home, police said.
Alleged incidents: On March 9, 2016, state police were investigating a separate case when they determined Smith had sexually abused two juveniles about two years before, they said.
Police said the two children tried to get out of the garage, but Smith had locked it and they could not get out when they tried. One of the victims tried to get away but said Smith choked him to the point that he could not breathe, according to police.
"He reported that Smith threatened to hurt them if they told anything to anyone," the trooper wrote in charging documents.
One of the victims reported to police that Smith had touched them inappropriately, and Smith and the two victims were not wearing clothes when it happened, police allege. Both victims told authorities that he performed oral sex on them, documents state. The children were 11 and 7 at the time the incidents began, according to police.
The victims' parents told authorities that Smith was acquainted with their former roommates, and while Smith never lived with them, he visited a few times a week and stayed overnight two times, police said.
"(A victim's parent) related that Smith would play with both juvenile victims outside as well as play video games inside the house," the trooper wrote in charging documents.
On Aug. 5, Smith was reached by state police and refused to give an address for himself. When he scheduled an interview for Aug. 15, he never showed up, and he did not respond to further phone calls, according to police.
Other charges: York City Police filed charges Oct. 17 against Smith, alleging Smith had sex with a 13-year-old girl.
Police were told about the alleged incidents in August when the teen reported to police that Smith had intercourse with her, according to charging documents. She said it happened on more than one occasion in July or August, police said. The teen reported to police that Smith said he was 16, according to charging documents.
On Oct. 12, police spoke with Smith, and he said he did have intercourse with the teen on two separate occasions, once at her York City home and another time at a park where he plays basketball, police allege.
"Smith stated he knew it was wrong and that he had told (the girl) that he was 16," charging documents state. Police say he also thought she was 15 years old.
Smith was arraigned in front of District Judge Linda Williams on Oct. 21 on the previous charges, and was released on supervised bail. On Wednesday, Smith was arraigned in front of District Judge Keith Albright and was sent to York County Prison in lieu of $300,000 bail.
His preliminary hearing for the first set of charges is scheduled for Nov. 29 at Williams' office.
