Police: Springettsbury man had sex with 13-year-old
A Springettsbury Township man is accused of lying to a teenager about his age and sexually assaulting her, according to charging documents filed by York City Police on Oct. 17.
Brandon Lee Smith, who turned 25 on Sunday, of 1105 Eberts Lane, is charged with statutory sexual assault and sexual assault, documents state.
Police say Smith told a 13-year-old girl that he was 16 when he had intercourse with her.
Police were told about the alleged incidents in August when the teen reported to police that Smith had intercourse with her, according to charging documents. She said it happened on more than one occasion in July or August, police said. The teen reported to police that Smith said he was 16, according to charging documents.
On Oct. 12, police spoke with Smith, and he said he did have intercourse with the teen on two separate occasions, once at her York City home and another time at a park where he plays basketball, police allege.
"Smith stated he knew it was wrong and that he had told (the girl) that he was 16," charging documents state. Police say he also thought she was 15 years old.
Police obtained an arrest warrant for Smith on Oct. 17. On Friday, members of the U.S. Marshals Task Force arrested Smith in the 200 block of Park Place without incident, according to a release from the U.S. Marshals Service.
Smith was arraigned in front of District Judge Linda Williams on Friday, and he remains free on nonmonetary bail, according to online court records.
