Man pleads to lesser charges, avoiding possible rape conviction
A Harrisburg man is free on bail, awaiting sentencing for assaulting and intimidating his former girlfriend.
Brison Farmer, 26, of Cherrington Drive, had been charged with rape, aggravated assault, false imprisonment, involuntary deviate sexual intercourse and sexual assault, but those charges were dropped as part of an agreement in which he admitted to other offenses.
Farmer on Friday pleaded guilty to intimidating a witness, making terroristic threats, simple assault, indecent assault using forcible compulsion, access-device fraud, criminal mischief and receiving stolen property, court records state.
There is no agreed-upon sentence for Farmer, according to his defense attorney, public defender Joshua Neiderhiser. That's known as a "charge bargain" and means it will be up to presiding Common Pleas Judge Maria Musti Cook to determine Farmer's punishment.
Farmer maintains he is innocent of rape, his attorney confirmed.
He is scheduled to be sentenced June 27 but must first undergo a sexual-offender evaluation by state Megan's Law officials to determine if he is a sexually violent predator, court records state.
Farmer is on supervised bail, meaning he's closely monitored by county probation officers, according to Neiderhiser, who said his client has been ordered to have no contact with his victim and was fitted with a GPS-monitoring ankle cuff.
The allegations: West York Police filed charges against Farmer five days after the Aug. 12 incident inside the woman's borough home after being called by one of the woman's family members who was concerned she might have been seriously hurt during the assault.
Police reached out to the woman, who told them she was confronted by Farmer over infidelity issues while they were broken up, and she confessed she'd been seeing other men, police said.
"This infuriated Farmer, who began to brutally assault her over the next couple hours," charging documents state. The woman's children were home at the time.
Farmer repeatedly punched and slapped her in the face and legs and ordered her not to leave her home or call anyone, police allege.
He left but returned later and told the woman to meet him outside her house at her vehicle, where he forced her to perform oral sex on him while he punched her in the head and back, charging documents allege.
He then kicked her in the stomach and ordered her to go to her bedroom or he would beat her in front of her children, documents allege.
'I'm not done with you': Once in the bedroom, Farmer assaulted the woman with her cellphone, punched her in the face again and threw the phone at her face, police allege.
"He then gave her (a) towel and stated, 'Clean yourself up, I'm not done with you yet, I'm gonna beat you all night," charging documents state.
Farmer then whipped the woman with a ceiling-fan pull-chain and scratched and squeezed her breasts until they bled, then left her home, police said.
Second assault: Documents state Farmer returned to her home Aug, 17, at which time he punched her in the chest and allegedly asked, "Did you think the first time was the only time I was going to hit you?"
He kicked and punched her until she fell to the floor, then held a steak knife inches from her face while threatening to kill her, documents allege.
He scratched her breasts again, "which ripped open the scabs from the previous assault," according to documents.
A medical report from York Hospital found the woman suffered numerous injuries from head to foot, police said.
