York County commissioners, solicitor called to resign
A former York Township commissioner called on all three York County commissioners and the county solicitor to resign over what a county official called a misunderstanding based on a clerical error as part of a lawsuit.
Dennis Ness demanded the resignations of commissioners Steve Chronister, Doug Hoke and Chris Reilly as well as solicitor Mike Flannelly during the rarely used public comment portion of the weekly commissioners meeting on Wednesday.
Ness claimed the county asked the courts to be reimbursed by him for just under $4,000 in legal fees as part of an unsuccessful 2013 lawsuit he filed against them over Local Economic Revitalization Tax Assistance districts in the township.
A York County Court of Common Pleas judge dismissed the lawsuit, which was later appealed to the state Commonwealth Court where it was subsequently also dismissed, according to court records.
Ness left the meeting before county officials replied to his comments.
Error: Flannelly said Ness' allegations can be chalked up to a clerical error in a court filing.
"My suggestion to the three of you is not to resign," Flannelly told commissioners, adding he has no intention of voluntarily resigning.
The county, though listed as a defendant in court records, never had an active role in Ness' lawsuit and never requested to be reimbursed for costs, Flannelly said.
The attorney that had represented York Township in the case left the law firm where he worked, and the township's solicitor took over the suit. A notice filed in 2013 incorrectly listed the township solicitor as also representing the county, according to court filings.
Chronister said Wednesday was the first time he had heard about the issue.
"You at least think he'd reach out to somebody" at the county, he said.
The state Commonwealth Court ruled the township can't seek financial reimbursement from Ness.
