New York Wire Co. fined for on-the-job death in York
New York Wire Co. has been fined $5,600 for the on-the-job death of a longtime employee at its Spring Garden Township facility.
Stanley Foller, 63, of North York, was killed in March when an industrial-sized coil which weighed about 4,200 pounds fell on his chest at the Loucks Mill Road building. His cause of death, according to the York County Coroner's Office, was asphyxiation.
The Occupational Safety and Health Administration began investigations into the incident at Wire Holdings Co. in Hanover, which does business as New York Wire Co. immediately after incident occurred, and last month issued the company a citation for violating the Occupational Safety and Health Act, said Kevin Kilp, Area Director of the OSHA Harrisburg Area Office.
"The investigation was two-fold in purpose," he said. "First we wanted to figure out what happened, we wanted to figure out the working cause of the accident, and then we wanted to figure out how to prevent this from ever happening again."
Citation: "It was a violation of the general duty clause which essentially states employers must provide a safe and healthy work place for their employees," Kilp said. The general duty clause is cited "when there are no specific standards in place for the given incident."
According to the citation, "Employees were exposed to the hazard of being crushed by expanding coils of wire weighing up to 4,500 pounds" and furthermore, "the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards during the handling of compressed wire coils."
OSHA originally proposed a $7,000 fine. The company participated in an informal hearing with OSHA and the citation was reduced to $5,600, Kilp said.
