The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments that were inspected Jan. 9-22.

OUT OF COMPLIANCE

Regular inspections:

American Legion Post No. 543, 23 E. Broadway, Red Lion, 10 violations

Action: Violations included employee drinking coffee in open container in kitchen; ice scoop lying in direct contact with edible ice; chemical sanitizer at improper level; dried potato debris observed on cutting blades of mounted cutter; food splatter observed inside microwave; cigarette ashes observed in hand wash sink; no hand soap in basement restroom; no sign at sink reminding employees to wash hands; and can of aerosol stored inside kitchen cabinet.

Millennium Pizzeria, 26 S. Baltimore St., Dillsburg, 8 violations

Action: Violations included food employees observed in kitchen without proper hair restraints; accumulation of static dust on fan in walk-in cooler; accumulation of residue on metal racks in walk-in cooler; no soap available at hand wash sink in kitchen; no paper towels available in women's restroom; and chemical spray bottles not properly labeled.

Note: This is the third time this facility has been ruled out of compliance since January 2016.

Jim Mack's Ice Cream, 5745 Lincoln Hwy., 14 violations

Action: Violations included food stored directly on floor; ice scoop lying inside bulk ice machine; wet wiping cloth not stored in sanitizer solution; fluorescent bulbs stored in room with bulk ice machine and food; broken lid on bulk ice machine; pots, pans and utensils only washed in hot, soapy water without sanitizing step; accumulation of static dust on ceiling; no food employee certified in food safety; outdoor waste receptacle observed with open lid; paint peeling from walls; hammers and screwdrivers stored with food; and calcium hypochlorite stored on top of bulk ice machine.

Note: This is the second time this facility has been ruled out of compliance since January 2017.

Pizza Bolis, 240 S. George St., York City, 23 violations

Action: Violations included employees in kitchen not wearing proper hair restraints; food stored with no covering; food storage containers not properly labeled; utensils not properly cleaned and sanitized before use; wet wiping cloths not stored in sanitizer solution; chicken and drinks stored directly on floor; food not being date marked; food residue inside microwave; bottom area of freezer is dirty; wiping cloths not being cleaned daily; certified supervisory employee no longer available; hand wash sink not working; trash receptacles not properly covered; mops not being hung to air dry; and employee personal items stored on same shelf as take-out trays.

Lee's Diner, 4320 W. Market St., 19 violations

Action: Violations included bag of flour observed with water damage; back, flaky residue found inside ice machine; spoon and its handle buried in container of pasta sauce; heavy grease splatter residue observed under grill; ice scoop on table touching wet rag; wet wiping cloths not stored in sanitizer solution; food stored on basement floor (third consecutive violation); excess filth found inside dish machine reservoir; milk shake blender observed with dried food residue; clean dish racks stored on floor; old food residue observed in hand wash sink; rear door being propped open; mops not being hung to air dry; and gallon bottles of bleach stored on same shelf with food.

Note: This is the fifth consecutive failed inspection at this facility, which has been ruled out of compliance 16 times since April 2016.
