The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments that were inspected May 23-29.

OUT OF COMPLIANCE

Regular inspections:

Bill Mack's Ice Cream, 3890 Carlisle Road, Dover, 12 violations

Action: Violations included pork broth kept past sell-by date; chemical cleaner stored above or on same shelf as food and equipment; wet wiping cloths not stored in sanitizer solution; mold-like substances observed on walls and shelving of walk-in refrigerator; significant amounts of ice cream spillage observed inside freezers on shelving; sink set up without proper sanitizing method; no chemical sanitizer used to clean equipment and utensils; hot water not operating at hand wash sink; sink clogged; tile floor observed cracked; and large amount of standing water observed on floor of walk-in refrigerator.

Continental Food Truck, 1604 W. King St., 8 violations

Action: Violations included food employee stated she doesn't wear hair covering; knife stored between metal box and wall; food tongs stored on out-of-order water tap; hot dog and burger buns stored with non food items; commercially processed food improperly heated; non-food contact surfaces not cleaned frequently enough; lids observed in hand wash sink; no sign at hand wash sink reminding employees to wash hands; and no soap available at hand wash sink.

Lewisberry Convenience, 658 Wyndamere Road, Lewisberry, 12 violations

Action: Violations included mozzarella cheese and hot dogs not being date marked; person in charge answered incorrectly to food safety questions; bags and hand soap stored on same shelf as frozen drink base; food employee observed wearing bracelet; food employees observed without proper hair restraints; raw eggs stored above milk in walk-in cooler; black mold-like residue observed inside ice machine; single-use cups stored directly on floor; lights not shielded or shatter proof; and several ceiling tiles observed with water damage.

Note: This is the second time this facility has been ruled out of compliance since April 2017.

Lee's Diner, 4320 W. Market St., 7 violations

Action: Violations included person in charge answered incorrectly to food safety questions; filth and excessive frost observed inside freezers filled with frozen foods; various foods not in original packages stacked directly on floor of walk-in freezer; foods held at improper temperature; facility reusing plastic containers; cooking equipment observed with encrusted grease and soil accumulation; toilet in employee restroom extremely slow draining; employee restroom extremely dirty and dusty; and exterior wall in porch area observed with hole.

Note: This is the fourth consecutive failed inspection at this restaurant and ninth failed inspection total since July 2015.
