FOOD INSPECTIONS: 3 out of compliance
- Lee's Diner, with 13 violations, ruled out of compliance for eighth time since March 2015.
- Baker's Family Restaurant, in Dillsburg, ruled out of compliance for third time since March 2015.
The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.
Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.
Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.
Below is a list of establishments that were inspected Feb. 21-27.
OUT OF COMPLIANCE

Ginmiya, 2524 Eastern Blvd., 9 violations
Action: Violations included shrimp observed thawing in standing water; time used in lieu of temperature to control ready-to-eat foods; no available sanitizer test strips; table-mounted can opener obseved with food residue; heavy accumulation of black mold-like residue observed on fountain soda machine nozzles and ice machine deflector plate; accumulation of dried food observed on shelving inside walk-in cooler; syrup spillage observed in box storage; no hand wash sink located in employee restroom; cracked wall inside kitchen; and static dust observed on walk-in cooler fan guards.
Baker's Family Restaurant, 515 U.S. Route 15 N., Dillsburg, 12 violations
Action: Violations included food not properly date marked; cleaner spray bottles observed in kitchen with no labels; personal bags with perfume stored above utensils in kitchen; employee's open beverage container observed in dishwasher area; raw shell eggs stored above ready-to-eat foods; tongs stored in water at improper temperature; sticker residue observed on several clean food containers; large amount of food debris observed on kitchen floor; leak observed under hand wash sink in kitchen; gap observed in back door of facility; ceiling tiles missing in kitchen exposing insulation; and several small holes observed in wall in the kitchen.
Note: This is the third time this restaurant has been ruled out of compliance since February 2015.
Lee's Diner, 4320 W. Market St., 13 violations
Action: Violations included food not properly date marked; facility does not maintain food employee certification records; storage containers improperly labeled; knife handle observed in shredded cheese; wet wiping cloths not stored in sanitizer solution; time used in lieu of temperature to control ready-to-eat foods; floor made of concrete in kitchen; deeply scored cutting boards observed; non-food contact surfaces not cleaned frequently enough; and entire downstairs extremely dirty and dusty.
Note: This is the eighth time this restaurant has been ruled out of compliance since March 2015. The facility failed its inspection four times in a row between April 2016 and December 2016.
