FOOD INSPECTIONS: 3 ruled out of compliance

The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments that were inspected Nov. 8-14.


Regular inspections:

Four Points by Sheraton, 1650 Toronita St., 16 violations

Action: Violations included hand lotion, bottle of e-cigarette juice and batteries stored on same shelf as food and equipment; employee's open beverage container observed in kitchen; raw beef stored above ready-to-eat broccoli and mushrooms in cooler; raw chicken stored above raw pork; raw egg shells stored above ready-to-eat sauces; liquid strainer improperly stored; candy mints and fountain syrup stored directly on floor; food stored on same shelf as employee personal items; pasta and spices stored next to hand wash sink; ham, cheese and sauces held at improper temperature; warewashing equipment observed with food residue; table-mounted can opener observed dirty; clean dish racks stored on floor; brown residue observed in hand wash sink; plumbing system not maintained in good repair; floor near dry storage made of concrete; no sign at hand wash sink reminding employees to wash hands; hallway extremely dirty and dusty; hole observed in ceiling in dry storage room; and insect webbing observed in hallway leading to loading dock door.

Turkey Hill, 3690 E. Market St., 8 violations

Action: Violations included employees stated that utensils stored in customer self services roller are not washed every four hours; cases of Twix bars stored directly on floor; apples displayed without sneeze guards; donuts and prepackaged subs not clearly labeled with allergen ingredients; warewashing equipment observed with build up of brown stain and food residue; frozen beverage dispensing nozzle observed with black mold-like residue; brown residue observed in hand wash sink; and hand wash sink used to store employee drinks and foods removed from sale.

Other-than-regular inspections:


Lee's Diner, 4320 W. Market St., 4 violations

Action: Violations included loose rubber door gaskets on kitchen cooling units; sanitizing solution in warewash sink not at proper ammonia concentration; interior ceiling of ice machine observed with food residue; and plumbing system not maintained in good repair.

Note: This is the third time this restaurant has been ruled out of compliance in 2016 and sixth time since March 2015. The department noted 36 violations in its initial inspection on Nov. 7.
