The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments that were inspected Oct. 4-10.

OUT OF COMPLIANCE

Regular inspections:

Konvie Mart, 452 S. Duke St., York City, 21 violations

Action: Violations included food not being date marked; working container of cleaner stored on same shelf as food; expired baby food observed on shelf; utensils being used without proper sanitation; wet wiping cloths not stored in sanitizer solution; food stored directly on floor; prepackaged food improperly labeled; no available sanitizer test strips; employee using warewashing sink for food prep; slicer observed with food residue; cooling units observed dirty; no chemical sanitizer used on equipment or utensils after washing and rinsing them; trash receptacles extremely soiled; floors cracked and not easily cleanable; bathroom doors don't close by themselves; screen door in kitchen has a gap; personal food stored in deli case and freezer; facility is dirty and dusty; and mops not being hung to air dry.

St. Joseph's School, 236 Baltimore St., Hanover, 3 violations

Action: Violations included no available sanitizer test strips; plumbing system not maintained in good repair; and more than 150 roach-like insects observed on glue boards in the kitchen.

Note: The school passed its follow-up inspection on Oct. 13.

Bill Bateman's Express, 985 Far Hills Dr., New Freedom, 9 violations

Action: Violations included employee observed wearing bracelet, watch or ring; wet wiping cloths not being stored in sanitizer solution; open salad dressing container held at improper temperature; soda gun dispenser repaired with blue tape; self-serve soda dispenser heavily soiled with a caked-on brownish bacteria all around inside of nozzles; inside of microwave observed with food residue; accumulation of food residue underneath refrigerator handles; cooking equipment observed with encrusted grease and soil accumulation; fryers observed with large accumulation of dirt and food residue; inside of refrigerators heavily soiled; clean food equipment stored in wet manner; floor drains extremely dirty with large accumulation of liquid grease, food and trash debris; and old, unused equipment stored in rear and front area.

Note: This is the second time this facility has been ruled out of compliance since Feb. 2015.

Ginza Japanese Restaurant, 616 Shrewsbury Commons, Shrewsbury, 11 violations

Action: Violations included employees not wearing proper hair restraints; raw chicken stored above raw beef, vegetables and pork; scoop stored in ice machine with handle buried beneath ice; food stored directly on floor; time used in lieu of temperature to control ready-to-eat foods; inside of microwave observed with old food residue; clean dish racks stored on floor; mop bucket observed with dirty, murky water; fly strip located in food prep area with potential to contaminate food; paper towel dispenser empty at hand wash sink; soap not available at hand wash sink; evidence of live roach activity in kitchen near water heater; facility not removing dead roaches from floor, wall, tables and equipment; and 50-100 live roaches observed within kitchen area.

Note: This is the sixth time this restaurant has been ruled out of compliance since Sept. 2014.

McDonald's, 380 Memory Lane, 10 violations

Action: Violations included employees not washing hands correctly; food dispensing utensil observed stored in liquid butter; thermometer not accurate; ice machine chute observed with grey slimy mold-like residue; ice machine deflector plate observed with black mold-like residue; brown and grey mold-like residue observed on sprayer heads of soda machine; creamer dispenser observed with food residue; floor drain observed with accumulation of dust, dirt and food residue; wire shelving in grill area observed with accumulation of dust and dirt; sandwich wrap sheets stored uncovered; drain pipe leaking at three-basin sink; wall in slop sink made of tile; and exit door in rear area has gap.
