The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments that were inspected August 17-23.

OUT OF COMPLIANCE

Regular inspections:

McDonald's inside Walmart, 6250 W. Manchester Mall, West Manchester Township, 12 violations

Action: Violations included foods not being date marked; working spray bottle of disinfectant stored on same shelf as food; spice not properly labeled; time used in lieu of temperature to control potentially hazardous foods; pieces missing from salad table bain marie unit; ice chute of customer self-serve soda machine observed with black, pink, brown mold-like residue; sticky liquid spills observed in cupboard under soda machine; old food residue observed in hand wash sink; accumulation of static dust observed on fan guards; mops not being hung to air dry; and old, decaying winged insects observed on sticky strips in cupboard under soda machine.

Note: This is the second time this facility has been ruled out of compliance since Jan. 2016, when the establishment voluntarily closed after a fryer vat caught fire.

Victory Athletic Association, 471 S. Ogontz St., 12 violations

Action: Violations included baby powder stored on shelving above food prep table and next to microwave; spray bottles of cleaner stored under prep table and on top of steak sizzle platters; spray can of belt lube stored on same shelving unit as food; employee's open beverage container observed on food prep tables; raw ground beef, pork loins and whole beef stored on same sheen pan in walk-in refrigerator; ice scoop stored with handle in direct contact with ice; accumulation of food debris in buffet line holding wells; walls in kitchen unclean; food debris observed on cutting blade; accumulation of dried food debris splattered throughout microwave; buffet line sneeze shield observed greasy; rubber mats behind bar observed very sticky; heavy accumulation of grease spillage under deep fat fryers; accumulation of dust on fan guards in dishwashing room; moist wiping cloths observed balled up on cutting boards; purse stored on food prep table; and heavy accumulation of static dust on hood above convection oven.

Lyndon Diner, 1353 Kenneth Road, 4 violations

Action: Violations included leak at dishwashing machine; paint chipped off metal shelving in bain marie units; and plumbing system not maintained in good repair.

Note: This is the fourth time this restaurant has been ruled out of compliance since Nov. 2014 and second time this month.

Sweet House, 1208 Greensprings Dr., 8 violations

Action: Violations included food employees observed without proper hair restraints; wiping cloths observed in bucket of water with soap and bleach; shrimp sitting in sink; accumulation of frozen condensate inside bain marie unit; food contact surfaces not being cleaned with sanitizer; grease, dirt and food debris observed on floor under equipment in cook line; and plumbing system not maintained in good repair.

Note: This is the fourth time this restaurant has been ruled out of compliance since Dec. 2014 and third consecutive time since July 20, 2016.
