FOOD INSPECTIONS: 5 York County establishments out of compliance

  • Sbarro's was out of compliance for the third time since April 2015

  • Menges Mills Market LLC had several housefly-like insects near the meat cutter/deli area

The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.


Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments that were inspected June 8-14.


Regular inspections:

Dollar General, 1500 N. George St., 5 violations

Action: Violations included shampoos, soaps, insect repellent and pesticides stored above foods such as popcorn, candy and cookies on displays throughout the store. Several gallons of milk in the dairy cooler had passed their sell by date and severely dented cans of asparagus were on the retail shelving. The inspector also found cans without labels to identify them on shelves for sale and the front door was propped open. Finally, products in storage were "extremely dirty, dusty, with various products directly on floor and in need of cleaning.

Sbarros Italian Eatery, 2899 Whiteford Road, 12 violations

Action: Violations included the person in charge not having adequate knowledge of food safety; containers of all-purpose cleaner and sanitizer stored above a wash basin and on the same shelf as utensils and thermometers, as well as a partially used can of enamel paint; an open employee's beverage container was above the food preparation table on shelving; employees were not seen wearing proper hair restraints such as beard covers; exposed food in the customer service area being exposed to air from dirty, dusty fan blades; Alfredo sauce and pasta salad not being properly marked with the date opened; the facility didn't have available test strips or a test kit to determine the appropriate sanitizer concentration; the ammonia concentration in the sanitizing solution was incorrect; bulk dry good bins had an accumulation of dust, dirt, food residue and debris on non-food contact surfaces; the plumbing system had not been maintained; there was no sign posted in the rear area to remind employees to wash their hands, as well as no paper towels or soap in the same rear area at the hand-wash sink; and a heavy accumulation of grease and static dust on filters of both hood ventilation systems.

Note: This is the third time this restaurant has been out of compliance since April 2015.

Heritage Hills Golf Resort, 2700 Mount Rose Ave., 16 violations

Action: Violations included the person in charge not having adequate knowledge of food safety; an employee's open beverage container was above flatware in the wait station of Oak restaurant; food dispensing utensil in bulk sugar, flour and breading observed stored in the food and not with handle above the top of the food and the container in the Oak kitchen; two cases of jalapeno food wraps stored directly on the floor rather than six inches off the floor; pasta salad, crab cake, chicken wings located in the Knickers reach in refrigerator not having date marked; loose or broken door hinges on the salad bain marie in Kickers kitchen; deeply scored cutting boards not resurfaced or discarded on all bain marie units in Knickers kitchen; old food in the rinse sink of Links kitchen; ammonia chemical sanitizer residual detected in the final sanitizer rinse cycle of the low-temperature sanitizing dishwasher was below 50 ppm, and not 200 - 400 ppm as required by manufacturer; utensils in drawers and clean bins were not clean and soap not available at the handwash sink in Oaks kitchen.

Menges Mills Market, 5995 Colonial Valley Road, Spring Grove, eight violations

Action: Violations included possible cross contamination; macaroni salad not being properly labeled with the name of the food and the ingredients; dried, hardened raw meat found on knives in clean knife rack and on the bandsaw blade; the deli meat and cheese slicer and the meat grinder not being cleaned every four hours; and two to three life housefly-like insects in the meat cutter/deli area.

Action: Violations included bathroom cleaner being stored in a cabinet with packages of blue cheese dressing; a Subway employee eating a sandwich in the food preparation area; a refrigerated case on the retail floor containing sandwiches, wraps, yogurt, eggs, salad and Lunchables with an internal temperature of 56 degrees F; and grab and go items such as egg, sausage and cheese sandwiches made and packaged without being labeled with ingredients, major allergens or the name and address of the store.
