The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, employee hygiene and issues with chemicals and how they're handled.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments that were inspected April 9-15.


Follow-up: All In One Stop, 303 N. Baltimore St., Dillsburg, 4 violations

Action: Violations included two milk gallon containers for sale with expired dates; an employee was dumping milk in the handwash sink, indicating uses other than handwashing; a working chemical container was stored above and on the same shelf with equipment; and old, unused equipment being stored in the storage area should be removed from the food facility.

Follow-up: Sbarros Italian Eatery, 2899 Whiteford Road, 5 violations

Action: Violations included a food employee was observed touching mushrooms, a ready-to-eat food, with bare hands; the facility ws using chlorine test strips to test quaternary ammonia sanitizer; soda nozzles, a food-contact surface, had food residue and were not clean to sight and touch; the bain-marie is still not working; and two thermometers read 32 degrees while sitting at room temperature.

Complaint: Parma Pizza & Grill, 220 Maple St., Manchester, 8 violations

Action: Violations included raw shell eggs were stored overtop of ready to eat foods in the walk-in refrigerator (was corrected on the spot); marinara sauce was on a tabletop electric steam table with an internal temperature of 86 degrees rather than 135 degrees or higher (corrected on the spot) and meatballs in a tomato based sauce were on a tabletop electric steam table with an internal temperature of 118 degrees rather than 135 degrees or higher (corrected on the spot); the refrigerated bain-marie unit was being operating with an internal ambient air temperature of 63 degrees for an undetermined amount of time rather than 41 degrees or lower. The internal temperatures taken on Time Temperature Controlled for Safety Foods ranged from 63 to 64 degrees (approximately 50 pounds of the food, worth an estimated $100, was disposed of), and garlic infused oil was being stored at room temperature rather than at 41 degrees or lower (corrected on the spot); the person in charge failed in their duties and responsibilities as evident by this non- compliant inspection report; food employees were involved in food preparation with full facial hair and not wearing proper hair restraints, such as a beard cover; time in lieu of temperature was being used in the food facility to control ready to eat Time Temperature Controlled for Safety Foods (displayed prepared pizza and sandwiches) without written documentation or up-to-date documentation to verify preparation or disposition time of food; equipment was not maintained in good repair or proper adjustment and the refrigerated bain-marie unit was operating with an internal ambient air temperature of 63 degrees rather than 41 degrees or lower; and the food facility does not have the original certificate for the certified food employee posted in public view.

Regular inspection: Hong Kong Buffet, 128 Newberry Parkway, Etters, 14 violations

Action: Violations included food in the walk-in cooler area was stored open with no covering; wet wiping cloths were in sushi area, not being stored in sanitizer solution; dumplings were held at 115 degrees instead of the required 135 degrees or higher; shrimp was held at 70 degrees in the three-compartment sink area, rather than at 41 degrees or below as required (product was discarded); a small leak was seen underneath the mechanical warewash machine; a mixer, a food-contact surface, had food residue and was not clean to sight and touch; cooking equipment in the grill area had encrusted grease and soil accumulation and the top of the warewash machine had an accumulation of old food residue and debris (non-food contact surfaces); the person in charge did not demonstrate adequate knowledge of the state food code as evidenced by the non-compliant inspection; food was stored directly on the floor in the walk-in freezer area rather than 6 inches off of the floor as required; shrimp was thawing in standing water in the three-compartment sink, which is not an approved thawing method; time was used in lieu of temperature in the food facility to control ready to eat, potentially hazardous foods without written procedures or documentation to verify disposition of food; deeply scored cutting boards were not resurfaced or discarded as required; single-use aluminum cans were re-used multiple times for food storage and/or preparation; and the facility has an employee who held a Certified Food Manager certificate; however, the certificate was expired and no longer valid.
