The Times-Tribune of Scranton reports ( http://bit.ly/14I6tBD) attorneys for ex-Luzerne County Judge Mark A. Ciavarella Jr. (shiv-uh-REL'-uh) want a federal appeals court to toss three convictions, including racketeering. They say jurors were never told the counts involved a statute of limitations.
In a filing Tuesday, attorney William Ruzzo said the 3rd U.S. Circuit Court of Appeals denied Ciavarella's appeal in May without addressing the statute of limitations issue.
A jury convicted Ciavarella on 12 of 27 counts, including racketeering and conspiracy, for pocketing a portion of more than $2.8 million in kickbacks. His former colleague Michael T. Conahan pleaded guilty in July 2010 to a racketeering charge.
Both are serving lengthy prison sentences.
