Erie County District Attorney Jack Daneri has not identified the worker at the Beer-4-Less story in Millcreek Township.
The DA tells the Erie Times-News ( http://bit.ly/W09DPR) that it was reasonable for the worker to use deadly force when he was confronted by 21-year-old Patrick Atkins, of Lake City, on Nov. 17.
Atkins was shot in the chest and police found him a short distance from the beer store, which he ran from after being shot during the attempted robbery about 8:15 that night.
Police say Atkins had a gun when he was found.
The employee had a license to carry the .357 Magnum he used to shoot Atkins.
