The state Superior Court last week found William Marx Jr. was no longer intoxicated when he awoke at a hospital and allegedly expressed regret that his neighbor was unharmed in the June 2011 incident in Jackson Township, York County.
The York Dispatch ( http://bit.ly/11k7ain) reports police say Marx was read his rights earlier then asked if he remembered them when he woke up. A county judge had found that wasn't sufficient.
Marx's attorney says his client has mental health problems and didn't mean to hurt anyone.
Investigators say Marx fired more than 30 large-caliber rounds into the adjoining home during a five-hour standoff.
