The attorney for Daniel and Karen Horner, of Johnstown, declined comment Monday on a lawsuit first reported by the Altoona Mirror ( http://bit.ly/SHds5V).
The lawsuit was filed by 36-year-old Michelle Petty who was shot in the hip when Horner also fatally shot another clerk at the Altoona Subway shop and, later, a 64-year-old bystander in April 2009.
Nicholas Horner, the soldier, is serving a life sentence for the shootings after unsuccessfully arguing that his post-traumatic stress disorder was to blame.
Petty's lawsuit contends his parents shouldn't have let him use the gun, given his mental state.
