The 3rd U.S. Circuit Court of Appeals agreed with a ruling last month that state rules governing access to polling places did not infringe on the Pittsburgh Post-Gazette's right to gather news.
The newspaper said a state law keeping anyone other than voters and election officials 10 feet from polling places prevented it from monitoring the sign-in process, which will differ this year under a new voter ID law.
The newspaper's ( http://bit.ly/SwDlq7) attorney says he plans a Supreme Court appeal because other circuit courts have favored more media access, but says it won't be resolved before Tuesday's election.
