ERIE, Pa.—A western Pennsylvania man has learned an interesting legal lesson: Just because a woman consents to sex, doesn't mean she has consented to having the act recorded.

As a result, 55-year-old Daniel W. Smith will spend 20 months on probation and must perform 50 hours of community service.

The Erie Times-News ( http://bit.ly/Ti6tnh0) reports Smith was living in Venango Township when police searched his home in an unrelated investigation in October 2011 and found four DVDs of recordings Smith secretly made with the woman several months before.

Smith didn't share the videos with anyone, but simply having them was a crime under the state's invasion of privacy law—which makes it illegal to photograph or record someone without their consent.

Erie County Judge Ernest DiSantis told Smith that recording the woman "for posterity, without her consent, is wrong."
