Chief U.S. Magistrate Judge Lisa Pupo Lenihan ruled Thursday that Cade Stevens' mother, Shannon Ferencz, waited too long to name Carol Younkin and Timmee Burnsworth as defendants in her lawsuit.
Ferencz sued the women, their employer PrimeCare Medical Inc., Fayette County, and multiple prison employees in September 2011.
She said her son and should have been put on suicide watch. On Sept. 12, 2009, Stevens hanged himself in his cell after he was arrested for robbery.
The judge agreed with the women's attorney, saying the two-year statute of limitations passed so they couldn't be parties to the suit.
