The Herald-Standard of Uniontown ( http://bit.ly/QwbdkL0) reports Thursday that U.S. Magistrate Judge Maureen Kelly rejected defense arguments, including that Mexican prosecutors waited too long to charge 29-year-old Dylan Ryan Johnson, of Nemacolin. She noted the murder charge is valid until the year 2033 under Mexican law.
Johnson has been in custody since he was arrested at his home on Feb. 7.
Johnson is charged with raping and murdering Hilario Garcia Rosales on Sept. 7, 2003 at a hotel in Empalme Escobedo in the Mexican state of Guanajuato.
Johnson's public defender has a policy of not commenting to the media.
