Cambria County District Attorney Kelly Callihan says the suspect's weapon was pointed at the officer, who could have been killed had he not acted as he did.
Forty-five-year-old Kevin McGee of Johnstown is charged with attempted homicide and aggravated assault. Police say he shot the window out of a police cruiser outside the Richland Township department on Sept. 13 and then refused to put down his shotgun before the officer fired.
McGee's preliminary hearing is scheduled Wednesday. Public Defender Patricia Moore told The (Johnstown) Tribune-Democrat that McGee didn't intend to harm any officers and she and her client are "very thankful no officers were hurt."
