The (Uniontown) Herald Standard ( http://bit.ly/QcGetW) says Fayette County President Judge Gerald Solomon wants attorneys to submit arguments about the charge and whether the defendant's statements should be allowed as evidence.
Thirty-six-year-old Johnathan Godines of Brownsville was originally charged with aggravated assault in the November beating of 75-year-old John Eicholtz, but he died Dec. 1, and an autopsy linked his fatal brain hemorrhage to the assault.
Godines earlier said the fight wasn't due to jealousy. He alleged that the older man "flashed a gun" during a traffic dispute.
