The (Easton) Express-Times ( http://bit.ly/Mjn7i2) reports that Northampton County Assistant District Attorney Kelly Lewis says 42-year-old Luis Alberto Montero of Jackson Heights, N.Y., knew what he was doing when he talked to Bethlehem police from his hospital bed.
Police allege that he shot 38-year-old Marjorie Reyes, the mother of his three children, in May 2011 and then turned the gun on himself.
Defense attorney Tim Prendergast argued last month that his client was on painkillers when he spoke to police, but prosecutors cited testimony from a doctor that he didn't appear "excessively drowsy."
Montero is scheduled for trial in August on a charge of criminal homicide.
