For the second time in three years, a Springettsbury Township woman is facing trial for allegedly driving drunk with a child in her car.
Joanna S. Smith had a 6-year-old boy in the back seat of her silver Mazda 3 about 12:45 a.m. May 27 when her driving caught the attention of a state trooper, according to her arrest affidavit.
The trooper arrested Smith and took her for a blood test, which showed her blood-alcohol level was 0.222 percent -- nearly three times the state's legal limit of 0.08 percent, police said.
According to the arrest affidavit, Smith was in the area of Mount Rose Avenue and Greensprings Drive in Springettsbury Township when her left tires crossed the center line. She then abruptly swerved to miss construction barrels, police said.
Smith turned left onto Greensprings Drive into the opposing lane of traffic, the affidavit alleges, then nearly struck another vehicle head-on.
Stumbled: The trooper noted Smith smelled strongly of alcohol, had slurred and confused speech and nearly fell multiple times while trying to perform field-sobriety tests, according to the affidavit.
Smith, 37, of 20 Bridlewood Way, Apt. C22, remains free on $20,000 bail, charged with DUI, endangering the welfare of a child, careless driving and disregarding a traffic lane.
The case against her was forwarded to York County Court at the close of a preliminary hearing Wednesday. Her formal court arraignment is set for July 19, according to court records.
Smith did not return a phone message seeking comment. Her defense attorney, Timothy Barrouk, was in court Thursday and could not be reached for comment.
Prior cases: In 2010, Smith was charged with DUI, child endangerment, reckless endangerment and fleeing police for causing an alcohol-fueled police chase in Springettsbury Township, allegedly with a child in her car, according to court records.
She later pleaded guilty to DUI, reckless endangerment
and fleeing police and was sentenced to two years of probation, records state. The child-endangerment charge was dropped.
Smith also was charged with drunken driving after a traffic stop in Manchester Township in 2009, records state.
She pleaded guilty to DUI for that incident and was sentenced to probation and ordered to attend DUI classes and undergo a drug and alcohol evaluation, records state.
