The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.
Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.
Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.
Below is a list of establishments listed as compliant and out-of-compliance for inspections conducted Nov. 19-20.
OUT OF COMPLIANCE
Brothers Pizza, 140 Newberry Parkway, Newberry Township.
Action: Violations included a working container stored on the same shelf with food, equipment and single-service articles in the serving/preparation area; a food employee did not follow proper handwashing procedures; food employee wore single-use gloves without a prior hand wash; an employee's open beverage container was observed in the preparation area; food employees were not wearing proper hair restraints; food in the walk-in cooler was stored open with no covering; raw chicken was stored above tomatoes; food ingredient storage containers were not labeled with the common name of the food; cup with handle was being used as a scoop in the sugar; food was stored directly on the floor in the walk-in cooler; pre-cooked raw chicken was observed thawing at room temperature, which is not an approved thawing method; time instead of temperature was being used in the food facility to control potentially hazardous foods without written procedures or documentation to verify disposal of food; cardboard was used on the shelf under the preparation table which is not a smooth, cleanable surface; shelf under the preparation table is rusty, which is not a smooth, easily-cleanable surface; temperature-measuring device for ensuring proper temperature of equipment was not available or readily accessible among the refrigeration equipment; food facility did not have available chlorine sanitizer test strips or test kit to determine appropriate sanitizer concentration; can opener blade, a food contact surface, was observed to have food residue and was not clean to sight and touch; no chemical sanitizer was used for storing wiping cloths and a sanitizer bucket was unavailable; single-service containers stored next to the handwash sink, which does not protect from splash, dust or other contamination; plumbing system not maintained in good repair; an empty paper towel dispenser at the handwash sink in the serving and preparation area.
Comment: A manager said violations were corrected within a day of the inspection.

Dillsburg Tobacco Outlet, Route 15 South, Dillsburg.
Action: Violations included an ice machine scoop immersed in a food container; consumer self-service area for ready-to-eat foods (hot dog rolls) was not provided with suitable utensils or dispensing method to prevent contamination; burritos were held at 85 degrees in the hot holding unit, rather than at 135 degrees or above as required; hot dogs were held at 126 degrees on the hot holding unit, rather than at 135 degrees or above as required; sandwiches and burritos were held at 46 degrees in the refrigeration unit, rather than 41 degrees or below as required; thermometers were not available or readily accessible; food facility did not have available chlorine sanitizer test strips or test kit to determine appropriate sanitizer concentration; tongs used for handling hot dogs were not cleaned throughout the day at least every four hours; soap was not available at the handwash sink in the warewash area; handwash sink in the warewash area did not have single-use towels, continuous towels or air-drying device; no sign was posted at the handwash sink in the restroom and warewash area to remind food employees to wash their hands; a mop was stored in the three-compartment sink, with potential to contaminate food equipment and utensils.
