The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as out-of-compliance for inspections conducted Oct. 7-14.

OUT OF COMPLIANCE

Cici's Pizza, 351 Loucks Road, York.

Action: Violations included missing grout or sealer; wiping-cloth sanitizer not held at proper levels; food scale not clean; food spatter on the underside of shelf above the salad and pasta bar; pizza racks were not clean to sight and touch; walk-in fan covers were not clean; non-food contact surfaces were not cleaned at a frequency to preclude accumulation of dirt and soil; handwash sink was used for other tasks; pooled water on walk-in floor; paper towel holder not working properly; old food and dirt on the floors and in hard-to-clean areas.

Dunkin' Donuts, 105 Glen Drive, Manchester.

Action: Violations included an employee not washing hands after eating; food employee had an exposed bracelet on wrist during food preparation; food or drink spillage inside edible ice in an uncovered ice storage bin; in-use spoons stored in standing water at the espresso machine; equipment not maintained in good repair; an accumulation of food debris on shelving units, food equipment, preparation tables and doughnut display areas; plumbing was not maintained in good repair; overflowing trash bin; improper storage of personal items; live fruit or sour flies in food preparation area.
