The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspect´ed twice per year, according to the Bureau of Food Safety and Laboratories.
Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should auto´matically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employ´ee hygiene.
Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.
Below is a list of establishments listed as compliant and out-of-compliance for inspections conducted Feb. 27-March 05.
OUT OF COMPLIANCE
Burger King, 490 Loucks Road, York.
Action: Violations included rodent-type droppings, too numerous to count, in the back corner of the utility room; back door held open with a rock, which could have allowed rodents and insects to enter; dirt and debris on the floors, especially in the corners and in the hard-to-clean areas.
Comment: A manager did not return calls seeking comment.

Paradise Pizza Express, 4265 N. Susquehanna Trail, York.
Action: Violations included an employee's open beverage container in the food preparation area; a food handler was not wearing a hair restraint; food was stored directly on the floor of the walk-in, rather than 6 inches off the floor as required; sauce was held below proper temperature; baine-marie was not hold proper temperatures; slicer and onion dicer were not clean to sight and touch; plumbing system was not maintained in good repair; floor tiles were chipped and cracked in several places of the facility.
Comment: Manager Marshall Buser said all violations have been corrected.

Sonic Store, 290 Wilson Ave., Hanover.
Action: Violations included food employee changing tasks, which may have contaminated hands, without a proper handwash in between; food employees in the preparation area were not wearing proper hair restraints, such as nets, hats or beard covers; food was stored without covering in a freezer; utensils were stored with handles in the food; a spatula at the grill was deformed and not durable for normal use; thermometers were not available or readily accessible in various freezers and refrigerators at the facility; not enough drainboards, utensil racks or tables to allow for storage of soiled and/or cleaned items before and after cleaning; three-bay sink in front of restaurant observed with build up of stains and not cleaned on regular basis; pans, can opener, utensils, knives, lids and doors were not clean to sight and touch; observed clean food equipment and/or utensils above three-bay sink stored wet and in a manner that does not allow for draining and/or air drying; hand wash sink in front of restaurant does not have adequate hot water pressure; door to the walk-in freezer does not close properly; mops are not being hung to air dry; food facility operator failed to post an orginal, valid food certification certificate in a location conspicuous to the consumer.
Comment: Manager Barb Sullivan said all violations have bee corrected.
