The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspect´ed twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should auto´matically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employ´ee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as compliant and out-of-compliance for inspections conducted Jan. 28-Feb. 4.

OUT OF COMPLIANCE

* Arooga's Grille House & Sports Bar, 1211 Haines Road, York.

Action: Violations included a spray bottle of chemicals in the bar area was not labeled; chlorine sanitizer in bar wiping cloth was above approprite levels; two servers did not wash their hands between touching dirty dishes and returning to work; internal temperature of the bar juice was 45 degrees; a visible thermometer in the bar refrigerator was missing; food employee was not using available sanitizer test strips or test kit to determine sanitizer concentration; chlorine chemical sanitizer residue was detected in the final sanitizer rinse cycle of the bar dishwasher; most bar soda nozzles were not clean to sight and touch; stickers and glue were on clean pans; clean pans, a food contact surface, contained food residue and were not clean to sight and touch; non-food contact surfaces were not cleaned at a frequency to preclude accumulation of dirt and soil; a box of single-use, to-go items was stored on the floor; souffle cups in tubes on the cooks line are not protected from contamination; clean dish racks were stored on the floor; trash dumpster lid was not kept closed; a ceiling was leaking water.

Comment: A manager said all violations have been corrected.

* Lees Diner Inc., 4320 W. Market St., York.

Action: Violations included a food employee wearing single-use gloves without a prior hand wash; wiping cloth sanitizer exceeded appropriate levels; a front line cook was touching ready-to-eat foods with his bare hands; raw pork was stored above ready-to-eat foods in the walk-in refrigerator; scoop used in the sugar bin did not have a handle; food was stored directly on the floor in the walk-in freezer, rather than 6 inches off the floor as required; front ice cream freezer was lined with duct tape; visible thermometer was not available in the refrigerator; two refrigerators in the kitchen have ambient temperatures of 43 degrees; cutting board was not clean to touch; interior of the ice machine, a food contact surface, contained food residue; slicer contained food residue; door handles were not clean to sight and touch; interior of microwave contained food residue; boxes of single-use, to-go items were stored on the basement floor; front sink by the cooks station was not working.

Comment: A manager did not return a message seeking information.

* Saubel's Market, 65 E. Forrest Ave., Shrewsbury.

Action: Violations included an employee's open beverage container was observed on the process table in the food preparation area; the package machine contained food residue; slicer had dried product accumulation and was not being cleaned every four hours as required.

Comment: A manager could not be reached for comment.

* Viking Athletic Association, 318 N. Adams St., York.

Action: Violations included the hood system, which removes grease vapors, was not working and released excessive fumes and vapors in the building.

Comment: An association member did not return a voicemail seeking comment.
