The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspect´ed twice per year, according to the Bureau of Food Safety and Laboratories.
Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should auto´matically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employ´ee hygiene.
Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.
Below is a list of establishments listed as compliant and out-of-compliance for inspections conducted Nov. 5-Nov. 9.
OUT OF COMPLIANCE
Bakers Family Restaurant, 515 Route 15 North, Dillsburg.
Action: Violations included a plumbing system that was not maintained in good repair - pipes were leaking near the potato peeler, and standing water was observed outside the walk-in freezer in the basement; women's restroom was not provided with a trash bin for sanitary napkins; ice cream scoop was stored in a container of water, which was not maintained at proper temperatures; bowl used as a scoop stored directly in the croutons; numerous deeply-scored cutting boards were not resurfaced or discarded as required; chlorine concentration in the sanitizing bucket was below proper levels; black residue was on gaskets of the refrigeration units; lemon juice was held above required temperature; mashed potatoes were held above required temperature; clean dish racks were stored on the floor; no sign was posted at the handwash sink in the employee restroom, reminding them to wash their hands; paper towel dispenser was empty at the handwash sink in the employee restroom; trash can in food preparation area was damaged and cracked, which is not a smooth, easily-cleanable surface.
Comment: A manager said the violations were minor and have been corrected.
Perkins Restaurant & Bakery, 2500 E. Market St., York.
Action: Violations included filth and food residue on mechanical warewashing equipment, which was not cleaned before use; a food handler arrived for work and had to be told by the inspector to wash his hands prior to starting work; wait staff was not washing hands after busing tables and handling dirty dishes; paint was stored above food in the back room; lemon wedger contained food residue; pans stored as clean contained food debris; shake machine contained food residue; equipment door handles contained food residue; insides of two microwaves were extremely soiled; chlorine sanitizer test strips were not available to determine concentration levels; server refrigerator was not holding food at proper temperatures; food employees were observed touching ready-to-eat food with bare hands; clean food equipment was stored while wet, not allowing time for proper draining and/or air drying; an employee's open beverage container was observed in the food preparation area; intake/exhaust air duct was emitting dust and dirt into the air; clean dish racks were on the floor; several plastic pans were cracked and not easily cleanable; employees could not properly wash their hands because hot water was not available at the hand sinks; chlorine chemical sanitizer was not detected at proper levels; food was not held at proper temperatures.
Comment: A manager said all violations have been corrected.
Shultzie's and Tailgaters, 204G St. Charles Way, York.
Action: Violations included no signage at the handwash sinks reminding food employees to wash their hands; four containers of various sauces were not refrigerated after opening date, despite recommendations on labels; underside of the shelf above the cooks' line was not clean to sight and touch; two bar soda guns were not clean to sight and touch; two food slicers were not clean to sight and touch; two refrigeration units were not keeping temperatures of 41 degrees or lower; chlorine chemical sanitizer was not detected at required levels.

Silver Lake Inn, 1295 Lewisberry Road, Lewisberry.
Action: Violations included a large amount of grease around the grill and fryer area; the wash/rinse solution temperature was 70 degrees, which is 50 degrees below the mininum required temperature; wood floor in fryer/grill area, which cannot be easily cleaned; old food residue accumulation in bottom of the freezer; interior ice machine and three-compartment sink had separated seals and edges, keeping the surface from being easily cleaned; hot water was not under pressure during inspection; can opener blade contained old food residue; cutting board contained excessive, deep scores, preventing it from being an easily-cleaned surface; old food residue observed under the cutting board on the baine marie; chicken pot pie was was not held at proper temperatures; sanitizer test strips were not available.

Action: Violations included an accumulation of dust, dirt, debris and food residue on equipment in the kitchen area; chemical sanitizer was not being used on equipment and utensils after washing and rinsing them, or prior to use; observed food employee wiping hands with soiled cloth towel; food employee wore single-use gloves without a prior hand wash; paper towel dispenser was empty at the handwash sink in the kitchen area; a food employee was observed touching a sandwich with bare hands.
