A York man who allegedly stole batteries during Hurricane Sandy is charged with a felony.
That's because state law makes shoplifting emergency supplies during an emergency storm a felony, rather than a misdemeanor, according to West York Police.
Joseph Ronald Giunta, 42, no address provided, is charged with retail theft and possession of drug paraphernalia, police said.
According to police, about 12:45 p.m. Monday Giunta stole numerous batteries from the Dollar General store, 1240 W. Market St., during the hurricane.
Officers found heroin-related paraphernalia in his possession when they were arresting him, police said.
