The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as out-of-compliance for inspections conducted May 23 - May 30.

OUT OF COMPLIANCE

Blue Koi, 805 Baltimore St., Hanover

Action: Violations included a food employee not following proper handwashing procedure; severely dented, swollen, distressed canned items in storage area for sale or use in the food facility; a sushi chef using bare hands to touch and mix vegetables for sushi wraps; eggs and flour stored on the floor in the kitchen area; food employee donning single-use gloves without a prior hand wash; food in the walk-in cooler stored open with no covering; bags of chicken stored directly on the floor in the walk-in freezer area, rather than 6 inches off the floor as required; onions stored directly on the floor in the rear stock area, rather than 6 inches off the floor as required; in-use knives and/or cleavers stored between table edges or between tables, an area not easily cleanable and sanitized; food utensils stored in a container of water not maintained at 135 degrees; plastic cups/bowls being used as scoops to remove food items at the time of inspection; food held 17 degrees above required, refrigerated temperature; wet wiping cloths in sushi and kitchen areas not being stored in sanitizer solution; wiping cloths being used for multiple tasks, wiping food spills, working with raw animal foods; refrigeration unit on cooks line not functioning properly; food residue on can opener; floor drain soiled with trash, food, dirt, dust and deceased insects; no working sanitizer solution in sushi and kitchen area to sanitize tables, counter tops and equipment; no bleach in the facility; clean food equipment and/or utensils were stored uncovered or not inverted; plumbing system not maintained in good repair; delivery door located in the rear of the kitchen area has a large gap at the bottom of the screen door and does not protect against the entry of insects, rodents and animals; large accumulation of static dust buildup on fan grates in the walk-in cooler and commercial fan in the kitchen area.

China One, 840 N. Route 15, Dillsburg

Action: Violations included employee personal items in dry storage area; plastic and aluminum containers without handles used as scoops; multiple food items in the walk-in cooler stored open with no covering; food in the bain marie held between 45 and 55 degrees, rather than 41 degrees as required; single-use aluminum cans being re-used multiple times for food storage and/or preparation; a large accumulation of old food and dirt residue on the floor and shelving of the walk-in cooler; handwash sink located in the food preparation area did not have water at a temperature of at least 100 degrees; wiping cloths stored on counters and not in sanitizer buckets; metal container stored outside to dry which was not protected from contamination; cooked chicken observed in the handwash sink, indicating uses other than handwashing; rear door of the food facility had a gap and did not protect against the entry of insects, rodents and other animals.

Field House Etters, 895 Old Trail Road, Etters

Action: Violations included chlorine chemical sanitizer residue detected in the final sanitizer rinse cycle of the low temperature sanitizing dishwasher; loose rubber door gaskets observed on the reach-in cooler cooling unit; slicer, microwave, area behind grill and mixer had an accumulation of old food residue; observed employee dumping drink down handwashing sink, indicating uses other than handwashing; dirty wiping cloths laying on counters and not in sanitizer solution; clean dish racks observed stored on the floor in warewash area; no sign or poster posted at the handwash sink in the food preparation area to remind food employees to wash their hands.

Maple Donuts, 50 Robin Hood Drive, Etters

Action: Violations included the food facility using chlorine sanitizer at an extremely high concentration; food employee wearing watch or ring on hands or arms; deli ham, chicken salad, tuna salad, macaroni and beef, and fruit syrups were held between 44 and 47 degrees in the reach-in cooler, rather than 41 degrees or below as required; an accumulation of residue under the shelving in the dry storage area; ice machine had an accumulation of residue on the food contact surfaces; light was not shielded or shatterproof above the dishwashing area; old glue boards filled with residue under shelving in the dry storage area; food facility operator failed to post an original, valid Food Employee Certification in a location visible to the consumer.

Comment: Manager Dawn Shermeyer said all violations have been corrected.

Two Brothers Bar and Grill, 1570 Robin Hood Drive, Etters

Action: Violations included food stored open with no covering in the bain marie; surface on pizza preparation area was cracked and not a smooth, cleanable surface; a missing hot water knob at the hand sink in the bar area; paper towel and soap dispensers were not available at the hand sink in the bar area.
