The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as out-of-compliance for inspections conducted May 15 - May 22.

OUT OF COMPLIANCE

Flapjacks, 9 N. Route 15, Dillsburg

Action: Violations included employee's personal items in food storage area; bowl and plastic container used as scoop in food containers; food storage containers not properly labeled; wiping cloths not stored in sanitizer solution; pies not held at proper temperatures; food cooling at room temperature on the counter; damaged floor in the walk-in cooler; deeply scored cutting boards; accumulation of dust, dirt, food residue and debris behind grill equipment; food residue on shelving in walk-in cooler; soap not available at the handwash sink in the bar area; ceiling tiles were damaged or missing in the kitchen area; broken wall and floor tiles in the dishwashing area.

Comment: A manager did not return a call seeking comment.

Hardee's, 2020 W. Market St., York

Action: Violations included an employee cutting and touching ready-to-eat buns with her bare hands; inside of the portable steam table was not clean; slicer contained food residue; microwave door handles were not clean to sight and touch; equipment food contact surfaces and utensils were not being immersed for a minimum of 10 seconds in the chlorine sanitizing compartment of the manual warewashing sink; dust on the ceiling tiles; excessive crumbs and debris on the shelf the microwave is sitting on; excessive dust and debris on the shelf above the fryers; intake/exhaust air duct needs to be cleaned or have its filters changed, as it is emitting dust and dirt into the air.

Comment: Manager Justin Thompson said all violations have been corrected.

Shank's Mare, 2092 Long Level Road, Wrightsville

Action: Violations included thermometers for ensuring proper temperatures of food were not available or readily accessible inside the reach-in refrigerator; food facility is using an approved non-public water system, but does not have current laboratory testing results for water potability. Compliance is required within 10 calendar days of the inspection.

Comment: Owner Liz Winand said the testing has been done and submitted to the inspector, and the thermometer was fixed inside the refrigerator.
