The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as out-of-compliance for inspections conducted March 26 - April 1.

Action: Violations included rodent poison underneath hibachi grill; person in charge not able to produce records showing that raw or partially cooked, ready-to-eat fish was frozen by the facility or approved supplier as required; onions and food containers stored directly on the floor in the kitchen; improper labeling of cleaning chemicals; a food employee washing their hands at the single-compartment sink rather than the designated handwash sink; food employee did not wash hands for at least 20 seconds; improper labeling of food-storage containers; food employee touching sushi rolls with bare hands; wet wiping cloths not being stored in sanitizer solution; bowls used as scoops in numerous food containers; eggs held at 68 degrees, rather than 45 degress or below as required; sanitizer test strips or test kit not available; broken doors on sushi display case being repaired with duct tape; black mildew, dirt and trash debris around dishwashing unit; grease and soil dripping from suppression lines above the stove; single-use food equipment and/or utensils stored uncovered in kitchen area; old, dirty, murky water inside mop bucket; leaking sinks; grease build-up on grease traps in hibachi dining areas; mops not being hung to air dry.

Action: Violations included a food employee touching cooked crabcake and buns with bare hands; food stored without covering in walk-in cooler and freezer; raw hamburger stored above ready-to-eat food in walk-in cooler; food employees not wearing proper hair restraints; food-storage containers without labels; wet wiping cloths not being stored in sanitizer solution; ice scoop handle touching the ice; soup stored directly on the floor of the walk-in cooler; accumulation of dust on walls and ceiling fixtures; encrusted grease and soil accumulation on hood system above stove; food residue on microwave and slicer; cleaned and sanitized utensils stored with food-contact surfaces; single-service utensils stored on dirty shelf; clean utensils stored in dirty bins; dirty utensils stored with clean utensils; single-service trays stored uncovered or not inverted.

Starlight Diner, 1177 Carlisle St., Hanover

Action: Violations included extremely dirty, dusty food-preparation area and cooks' line; improper labeling of cleaning chemicals; food in the stock area and walk-in cooler stored open with no covering; numerous food containers not properly labeled; food utensils in dessert area stored in a container of water that was not maintained at 135 degrees; ice buckets repaired with a white silicone substance; deli meat not marked with the date it was opened; loose and broken rubber door gaskets on freezer unit; encrusted grease and soil accumulation on fryers, ovens, grill and other cooking equipment; old food debris on mixer; food, trash and standing murky water on floor drain of cooks' line; old, dirty grease build-up on walls and suppression lines behind cooks' line; dumpster doors left open; floor in rear area of restaurant not a smooth, easily cleanable surface; floor in dishwashing area missing numerous floor tiles and covered up with cardboard; unused equipment stored in dry stock area.

Comment: Owner Shady Habib said all violations have been corrected.
