The state Department of Agriculture conducts annual inspections of food-serving businesses to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.

Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.

Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.

Below is a list of establishments listed as out-of-compliance for inspections conducted Jan. 24-27.

OUT OF COMPLIANCE

Burger King, 2400 Mount Rose Ave., York.

Action: Violations included chemicals stored on a shelf with single-use items; food stored directly on the floor, rather than 6 inches off the floor as required; deeply scored cutting boards not resurfaced or discarded as required; hot hold units contained food residue; old stickers and glue on clean pans; shake machine contained food residue; ice machine deflector plate was not clean to sight and touch; grease accumulation in the hood filters; pooled water on the floor in the drive-thru area; floors were not clean; front door was not closing properly; light bulb and shield were missing in the walk-in; intake/exhaust air duct needs cleaned or filters changed because it is emitting dust and dirt into the air.

Comment: Manager Troy Garner said some violations have been corrected and others are in the process of being corrected. For example, new ceiling tiles were being installed Thursday night.

J&S Pizza, 1155 Carlisle St., Hanover.

Action: Violations included spray bottles not labeled with the contents; improper sanitizer levels; a food handler touched a raw hamburger patty and did not change gloves and wash hands; an employee's open beverage container was observed in a food-preparation area; a food employee touched ready-to-eat food with bare hands; time in lieu of temperature was being used to control ready-to-eat, potentially hazardous foods without written procedures or documentation to verify disposal of food; soap instead of sanitizer being used in wiping cloth bucket; baine-marie thermometer is not accurate; walk-in is missing a thermometer; no ammonia or chlorine test strips to test sanitizer levels; food was not properly cooled; food was not held at proper temperatures; stoppers in three-bay sinks not operating properly; can opener contained food residue; slicer contained food residue; inside of ice machine and microwave contained food residue; single-service, single-use articles stored directly on the floor instead of 6 inches off the ground; a dough hook stored on the floor; single-use, to-go items stored food side up; three-bay sink not set up correctly to wash, rinse and sanitize; hot water heater not producing enough hot water to sinks at the time of this inspection; women's restroom did not include a trash can for sanitary napkins; lights are not shielded or shatterproof in the walk-in; handwash sink in the kitchen area was blocked by a trash can and not accessible at all times for employee use; slow-closing water faucet in the women's restroom does not last for at least 15 seconds; restroom doors are not self-closing properly.

Comment: Manager Filomena Malvone said violations have been corrected or are in the process of being corrected.

New China, 170 Newberry Commons, Newberry Township.

Action: Violations included food employees changing tasks without washing hands in between, which may have contaminated hands; food employees not wearing proper hair restraints; wet wiping cloths were not being stored in sanitizer solution.

Comment: A manager could not be reached.

Paddock Restaurant, 3406 E. Market St., York.

Action: Violations included high ammonia sanitizer levels; food employee eating food in the food preparation area; food stored directly on the floor of the walk-in freezer; shellstock located in the walk-in did not have identification tags attached to the container; food employee not using available sanitizer test strips or test kit to determine sanitizer concentration; soda lines and non-integral cold plate device installed in ice bin and in contact with ice used for consumer beverages; both bar soda guns not clean to sight and touch; server soda nozzles were not clean to sight and touch; slicer contained food residue; old food and stickers on clean pans; a valid Food Employee Certification was not posted in a location conspicuous to the consumer.

Comment: General Manager Jonathan Spanos said all violations were corrected while the inspector was on site.

Perkins Restaurant, 300 Eisenhower Drive, Hanover.

Action: Violations included a container of cleaner stored next to a stack of clean dishes; a food employee did not follow proper handwashing procedures; a food employee touched a raw hamburger patty with gloved hand and continued working without changing gloves and washing hands; raw beef stored above raw pork in the walk-in; raw chicken stored above ready-to-eat ham in the walk-in; souffle cups without hands being used as scoops; a container of teriyaki glaze was not refrigerated after opening as stated on the label; torn and loose rubber door gaskets on the cooks line cooling unit; refrigerator not working properly; bio-film substance found inside mechanical warewashing equipment; inside of microwave contained food residue; single-use souffle cups and lids stored food side up; intake/exhaust air ducts need cleaned or filters need changed in several areas because they are emitting dust and dirt into the air.

Comment: A company offical could not be reached.

Pickle Barrell Cafe LLC, 1155 Carlisle St,, Hanover.

Action: Violations included hand creme stored on a table with food; an employee's open beverage container in a food-preparation area; food handler not wearing a hair restraint; wet wiping cloths not being stored in sanitizer solution; raw chicken stored above ready-to-eat food or drinks in the walk-in; food thermometer not properly calibrated; food stored directly on the floor in the walk-in, rather than 6 inches off the floor as required; food was not properly reheated; no ammonia test strips to test the sanitizer; not all refrigerators have visible thermometers; slicer contained food residue; food residue inside microwave; tubes of single-use cups were not protected from overhead contamination.

Comment: A manager said all violations were corrected.

Pretzel Plus, 1155 Carlisle St., Hanover.

Action: Violations included spray bottles not labeled with the contents; an employee chewing gum in a food-preparation area; a food handler not wearing a hair restraint; wet wiping cloths not being stored in sanitizer solution; food stored directly on the floor, rather than 6 inches off the ground; door under the soda dispenser was not working properly; thermometers were not visible in all refrigerators; ice machine deflector plate contained residue; stickers on clean pans; slicer contained food residue; hot water heater not producing enough hot water to supply sinks; handwash sink in the restroom was blocked by a washer and dryer and was not accessible at all times for employee use; single-service, single-use articles stored directly on the floor and not 6 inches off the ground as required; restrooms did not have a self-closing door; pipe in the old restroom was not properly capped to keep water from leaking.

Comment: Owner Robin Baummer said all violations were minor and have been corrected.

Royal Farms, 101 Carlisle St., Hanover.

Action: Violations included oven cleaner stored on a cutting board; cleaner stored next to food; food employee not wearing a beard cover; 12 pints of milk for sale past the expiration date; inside of the cappuccino machine caked with old powder mix; soda nozzles not clean to sight and touch; trays of old chicken breading inside the warmer from the previous day's business; potato cutter not clean to sight and touch; excessive grease on the slides of potato cutter, which could fall into the food; static dust on signs above the preparation area; an excessive accumulation of old food on door gaskets in the warmer; three-shelf cart not cleaned properly; hot water not hot enough in the rest rooms; a paper towel holder installed at the coffee sink; water pressure significantly reduced when two sinks are turned on at the same time; floor drain at the three-compartment sink not clean to sight or touch; intake/exhaust air duct needs cleaned or filters need changed; a valid Food Employee Certification was not posted in a location conspicuous to consumers.
