The state's Department of Agriculture conducts yearly inspections of food-serving establishments to ensure public safety and safe food-handling practices. Schools are inspected twice per year, according to the Bureau of Food Safety and Laboratories.
Whether an establishment is considered compliant or non-compliant is the discretion of the inspector. There are, however, several violations for which inspectors should automatically consider establishments non-compliant. Called "critical violations," they include food temperature issues, issues with chemicals and how they're handled, and employee hygiene.
Depending on the severity of the situation, inspectors and their supervisors could file citations or close an establishment.
Below is a list of establishments recently listed as in or out of compliance for inspections.
OUT OF COMPLIANCE
American Legion Post 791, 1490 Poplar Road, York.
Action: Violations are: person in charge does not have adequate knowledge of food safety; employee personal items in the bar area, not in dressing rooms or identified storage area as required; a dead insect in a bottle of liquor; food facility is using/offering for sale smoked cheese prepared in an unapproved private home; several raw animal foods were stored above ready-to-eat foods in several places; cooled foods were not reheated to 165 degrees within two hours for hot holding; commercially processed ready-to-eat food in the walk-in and held more than 48 hours, have not been marked with the date they were opened; food thermometer is not scaled to measure to +/- 2 degrees; bar soda guns not clean to sight and touch; and clean pans have old stickers and glue on them.
Comment: A facility official could not be reached for comment.
Philly Boyz Cheese Steaks, 2899 Whiteford Road, York.
Action: Violations: spray bottle not labeled with contents; person in charge does not have adequate knowledge of food safety; a dirty plastic pan without a handle used as an ice scoop; freezer door is not tight fitting due to excessive accumulation of ice; a slicer and the underside of a cutting board both had food residue and was not clean to sight and touch; table fan is dirty and requires cleaning; single use to-go items are stored food side up; food facility operator failed to post an original, valid Food Employee Certification in a location conspicuous to the consumer.
Comment: Philly Boyz manager Stan Thomas said the business is "now in compliance" after the violations were corrected and the facility was reinspected Thursday.
Sbarros Italian Eatery, 2899 Whiteford Road, York.
Action: Violations are: chemicals stored over the sanitizer end of a three-bay sink; unauthorized child in food prep area, as the person in charge (general manager) failed to control access to food facility by unauthorized persons; person in charge does not have adequate knowledge of food safety; chemicals stored over single-use items; chlorine level in the wiping cloth bucket was in excess of 200 parts per million; food employee wearing single-use gloves without prior hand wash; employees not wearing hair restraints; wet wiping cloths not stored in sanitizer solution; time in lieu of temperature being used in the food facility to control ready-to-eat potentially hazardous foods without written procedures or documentation to verify disposition of food; food facility does not have available sanitizer test strips or test kit to determine appropriate sanitizer concentration; two-door refrigerator not working; water leaking from the ceiling inside the walk-in; ice machine deflector plate not clean in the corners; soda nozzles had gross amounts of residue and were not clean to sight and touch; Single-use to-go items stored food side up; ice and soda in front hand sink, indicating sink is used for other tasks than hand washing; two hand sinks were blocked with various items which made hand washing impossible; pooled water on the walk-in floor; Intake/exhaust air duct needs to be cleaned or filters changed, as it is emitting dust and dirt into the air; and several tiny flying insects in the mixer bowl used to make dough
Comment: A manager, who declined to give his name, said corrections were made and the facility was reinspected and is now in compliance.
Tokyo Nichi, 2899 Whiteford Road, York.
Action: Violations are: person in charge does not have adequate knowledge of food safety; food handlers not wearing hair restraints; raw chicken stored above butter in the front area; hood system not operating and filters missing; rice cooker in poor condition, plastic melting and not easily cleanable; lid to the rice storage container is broken and needs to be replaced; wet wiping cloths are not in any sanitizer; slicer had food residue and not clean to sight and touch; surface under the front grill not clean; walk-in fan covers have accumulation of static dust; paper towels were not available and napkins are not acceptable.

Action: Violations are: person in charge did not demonstrate adequate knowledge of state food code; food employee not wearing proper hair restraints; bulk soda nozzle lying directly on the facility's floor; food stored directly on the floor in the walk-in cooler and freezer, rather than 6 inches off the floor as required; temperature measuring device for ensuring proper temperature of refrigeration equipment not available in the drive-through area; heat lamp bulbs rubber coating peeling off at the french fry unit; tomato slicer had accumulation of old food residue; accumulation of residue on the floor behind the bulk soda boxes; fan guards in the walk-in cooler have accumulation of static dust; old food residue on and around the heat lamp area; food employee storing clean food equipment while wet, and not allowing time for draining and/or air-drying; clean strainer touching a trash receptacle and stored under a three-compartment sink; hand wash sink in the drive-through area does not have water at a temperature of at least 100 degrees; and hand wash sink in the ware-wash area was blocked by a trash receptacle and not accessible for employee use.
